NOVEMBER 28, 2005 <br />ROSEVILLE CITY COUNCIL RESOLUTION NO. <br />REGARDING THE ROSEVILLE CHARTER COMMISSION <br />WHEREAS the Roseville Charter Commission has five (5) openings <br />on the Charter Commission as of August 31, 2005, and the Honorable Chief <br />Judge of Ramsey District Court, Gregg Johnson, had the authority and <br />obligation to appoint those five commissioners by September 30, 2005, or <br />in lieu thereof, to notify the governing body of the City in writing of his <br />intent to do so within that 30 day period, all in accordance with MN SS 410.05 <br />attached hereto, and <br />WHEREAS, the City has no evidence that Judge Gregg Johnson <br />did in fact notify this governing body in writing of his intent to appoint <br />before October 1, but then appointed five persons to the Roseville Charter <br />Commission in violation of procedures as outlined above on or about <br />October 25, 2005. <br />NOW THEREFORE, the Roseville City Council does hereby resolve: <br />1. To direct the City Attorney to notify Judge Gregg Johnson of <br />the Council's desire and intent to appoint their own five members <br />to the Roseville Charter Commission as provided by MN SS 410.05 <br />for the four years August 31, 2005 to August 31, 2009. <br />2. To declare the five appointments made by Judge Gregg Johnson <br />on or about October 25, 2005 null and void due to lack of proper <br />procedures, and direct the City Attorney to request Judge Johnson to <br />withdraw his appointments, and to institute court action to so require <br />if he refuses to withdraw his order. <br />3. To cancel the Charter Commission meeting scheduled for 7 PM <br />November 30, 2005 in Council Chambers at City Hall, and to so notify <br />those who set up the meeting. <br />4. To appoint five citizens to the Roseville Charter Commission <br />on or before by December 15, 2005 at a special meeting to be <br />held on <br />
