EXTRACT OF MINUTES OF MEETING OF THE VARIANCE BO OF THE CITY OF ROSEVILLE Pursuant to due call and notice thereof, a regular meeting of the Variance Board of the City of Roseville, County of Ramsey, Minnesota, was held on the ls` day of September, at 5:00 p.m. The following members were present: Chair Bakeman, and Members Doherty and Boerigter. Variance Board Member Doherty introduced the following resolution and moved its adoption: VB RESOLUTION NO. 3 A RESOLUTION APPROVING A 10 FOOT VARIANCE TO SECTION 1009.03M OF THE ROSEVILLE CITY CODE FOR ROSE OF SHARON, INC. (KINDERBERRY HILL CHILD CARE), 2360 LEXINGTON AVENUE (PF3596) WHEREAS, Rose of Sharon, Inc. on behalf of Kinderberry Hill Child Care, has requested a VARIANCE to Section 1009.03M (Ground Signs) of the Roseville City Code to allow the installation of a ground (monument) sign within the required setback adjacent to Lexington Avenue; and WHEREAS, Kinderberry Hill Child Care is located at 2360 Lexington Avenue, and legally described as: Lot 1, Block 1, Rose of Sharon 2"d Addition PIN 11-29-23-32-0047 WHEREAS, 1009.03M requires all ground signs to be set back a minimum of 15 feet from a property line; and WHEREAS, the proposal by Kinderberry Hill places the ground sign 5 feet from the property line adjacent to Lexington Avenue; and WHEREAS, the City Planner has concluded that "hardships" are present and support can be given to deviate from the strict requirements of the Roseville City Code; NOW THEREFORE BE IT RESOLVED, by the Roseville Variance Board, to approve a 10 foot VARIANCE to Section 1009.03M of the Roseville City Code for Rose of Sharon, Inc. to allow the installation of a ground (monument) sign at Kinderberry Hill Child Care, 2360 Lexington Avenue, subject to the following condition: 1. The sign must be located a minimum of 5 feet from the property line adjacent to Lexington Avenue. 2. The sign must meet all applicable requirements of Section 1009.04 and 1009.08 of the Roseville City Code.
