EXT CT OF UTES OF FETING OFT E VAR NCE A OFT E CITY O ROSE LLE Pursuant to due call and notice thereof, a regular meeting of the Variance Board of the City of Roseville, County of Ramsey, Minnesota, was held on the 3rd day of May, 2006, at 5:00 p.m. The following members were present: Chair Bakeman and Members Boerigter and Doherty. Variance Board Member Doherty introduced the following resolution and moved its adoption: V~ RESOLUTION N0.35 A RESOLUTION APPROVING A V ANCE TO §703 OF THE OF THE ROSEVILLE CITY CODE FOR DONALD BROWN, 3086 SOUTH OWASSO BOULEV (PF3727) WHEREAS, Donald Brown has requested a VARIANCE to §703.04 (Regulation of Public Ways) of the Roseville City Code to allow the continuation of the existing 24-foot driveway setback from a street corner; and WHEREAS, this property is addressed as 3086 South Owasso Boulevard, and legally described as: GREEN 1dIEADOW LOT 15 BLIP 1 PID 01-29-23-12-0033 WHEREAS, Section 703.04 requires that driveway entrances in R-1 zones be setback at least 30 feet from the right-of--way of a street intersection; and WHEREAS, Donald Brown seeks to preserve the current 24-foot setback from the Woodlynn Avenue right-of--way of the existing driveway; and WHEREAS, the Planning Division has concluded that "hardships" are present and support can be given to deviate from the strict requirements of the Roseville City Code; NOW THEREFORE BE IT RESOLVED, by the Roseville Variance Board, to approve a 6-foot VARIANCE to Section 703.04B(4) (Standards For Driveways) to allow the continuation of the existing 24-foot driveway setback from the Woodlynn Avenue right-of--way. The motion for the adoption of the foregoing resolution was duly seconded by Variance Board Member Boerigter and upon vote being taken thereon, the following voted in favor: Members Bakeman, Boerigter, and Doherty; and none voted against;
