EXTRACT OF MINUTES OF MEETING OF THE VARIANCE BOARD OF THE CITY OF ROSEVILLE Pursuant to due call and notice thereof, a regular meeting of the Variance Board of the City of Roseville, County of Ramsey, Minnesota, was held on the 7th day of September, 2005 at 5:00 p.m. The following members were present: Chair Bakeman and Members Pust and Boerigter. Variance Board Member Boerigter introduced the following resolution and moved its adoption: VB RESOLUTION N0.27 A RESOLUTION APPROVING A ONE FOOT VARIANCE TO SECTION 1012.02B2 OF THE ROSEVILLE CITY CODE FOR BENJAMIN LEVITZ, 1465 ROSELAWN AVENUE (PF3668). WHEREAS, Benjamin Levitz has requested a one foot VARIANCE to Section 1012.02B2 of the Roseville City Code to allow the installation of a one foot lattice top on an existing four foot tall fence in his front yard; WHEREAS, the Levitz property is located at 1465 Roselawn Avenue, and legally described as: LOT 7, BLOCK 1, KAY-KEEN HOMESITES PIN: 15-29-23-23-0071 WHEREAS, City Code Section 1012.02B2 requires fences in front yards to be a maximum of four feet in height; and WHEREAS, the proposal by Mr. Levitz would add a one foot lattice top to the fence in the front yard for additional yard privacy; and WHEREAS, the City Planner has concluded that "hardships" are present and support can be given to deviate from the strict requirements of the Roseville City Code; NOW THEREFORE BE IT RESOLVED, by the Roseville Variance Board, to approve a 1 foot VARIANCE to Section 1012.02B2 of the Roseville City Code for Benjamin Levitz, 1465 Roselawn Avenue to allow a one foot extension of the existing four foot tall front yard fence, subject to the following conditions: 1. The fence must not exceed a height of 5 feet measured from the existing grade to top of fence\lattice. 2. The fence extension must be constructed of wood be a lattice design.
