XT CT O iJTES OF ETNG F ~' <br />VAIN NCE BOA OFT CITY OF R S I,I. <br />Pursuant to due call and notice thereof, a regular meeting of the Variance Board of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 4th day of October, 2006, at 5:30 p.m. <br />The following members were present: Chair Bakeman and Members Boerigter and <br />Doherty. <br />Variance Board Member Bakeman introduced the following resolution and moved its adoption: <br />I~ESI.TI 0.47 <br />A RESOLUTION DENYING A 15 FOOT V ANCE TO §1016.16 (WETLAND <br />SETBACKS) OF THE ROSEVILLE CITY CODE FOR THOlVIAS CDANIEL, <br />527 OWASSO HILLS DRIVE (PF3787) <br />WHEREAS, Thomas McDaniel has requested a VARIANCE to § 1016.16 (Wetland <br />Setbacks) to allow a living area encroachment into the required wetland setback; and <br />WHEREAS, this property is addressed as 527 Owasso Hills Drive; and <br />WHEREAS, Section 1016.16 requires a minimum 50-foot setback for principal <br />residential structures from wetland boundaries; and <br />WHEREAS, Thomas McDaniel seeks to expand the principal residential structure to <br />encroach into the required wetland setback; and <br />WHEREAS, the Variance Board found that the public interest would be best served by <br />protecting the wetland by preserving the integrity of the wetland setback requirement; and <br />WHEREAS, the Planning Division. has concluded that "hardships" are NOT present and <br />support CANNOT be given to deviate from the strict requirements of the Roseville City Code; <br />NOW THEREFORE BE IT RESOLVED, by the Roseville Variance Board, to DENY a <br />15-foot VARIANCE to Section 1016.16 (Wetland Setbacks), thereby prohibiting the proposed <br />principal structure encroachment into the required wetland setback: <br />The motion for the adoption of the foregoing resolution was duly seconded by Variance <br />Board Member Doherty and upon vote being taken thereon, the following voted in favor: <br />Members Bakeman, Boerigter, and Doherty; <br />And none voted against; <br />WHEREUPON said resolution was declared duly passed and adopted. <br />
