EXT CT F iTTS FETING F T E <br />VAIN NCE A F T E CITE' I+' I2SE I.I.,E <br />Pursuant to due call and notice thereof, a regular meeting of the Variance Board of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 6th day of September, 2006, at 5:00 <br />p.m. <br />The following members were present: Chair Bakeman and Members Boerigter and <br />Doherty. <br />Variance Board Member Boerigter introduced the following resolution and moved its adoption: <br />ESI.iTI N . 45 <br />A RESOLUTION APPROVING A V ANCE TO §1005 OF THE ROSEVILLE CITY <br />CODE FOR THE WALSER AUTOIVIOTIVE GROUP, 2775 HIGHWAY 35W (PF3785) <br />WHEREAS, the Walser Automotive Group has requested a VARIANCE to § 1005 <br />(Business Districts) to allow a parking area encroachment into the required side yard setback; and <br />WHEREAS, this property is addressed as 2775 Highway 35W, and legally described as: <br />LOT 3, BLOCK 1, P TO INDUSTRIAL P <br />PIN: 05-29-23-41-0005 <br />WHEREAS, Section 1005.01 requires a minimum 5-foot setback for parking areas from <br />the side property line; and <br />WHEREAS, the Walser Automotive Group seeks to pave a parking area up to the side <br />property line in order to preserve continuity with additional parking area on the adjacent <br />property; and <br />WHEREAS, the Walser Automotive Group is currently in negotiation with the Minnesota <br />Department of Transportation (MNDOT), owners of the parcel adjacent to the southern lot line of <br />the subject property, to lease a portion of the MNDOT property for additional parking area; and <br />WHEREAS, the Planning Division has concluded that "hardships" are present and <br />support can be given to deviate from the strict requirements of the Roseville City Code if the <br />conditions identified below are met; <br />NOW THEREFORE BE IT RESOLVED, by the Roseville Variance Board, to approve a <br />5-foot VARIANCE to Section 1005.01 (Minimum Dimensional Requirements -Side Yard <br />Parking Setback) to allow the pavement of the parking area up to the southern property line at <br />2775 Highway 35W, subject to the following conditions: <br />1.
