T CT OF UTS OF 'I'NO OFT E Vr~IZ 1`TCE BOA OFT E CITY OF I2S LLE Pursuant to due call and notice thereof, a regular meeting of the Variance Board of the City of Roseville, County of Ramsey, Minnesota, was held on the 2°d day of August, 2006, at 5:30 p.m. The following members were present: Chair Bakeman and Members Boerigter and Doherty. Variance Board Member Doherty introduced the following resolution and moved its adoption: ESUTIOl~ 1~T . 41 A RESOLUTION APPROVING V ANCES TO §1005 AND §1012 OF THE ROSEVILLE CITY CODE FOR CROIX OIL COIVIPANY, 3110 CLEVELAND AVENUE (PF3783) WHEREAS, the Croix Oil Company has requested VARIANCES to § 1005 (Business Districts) and § 1012 (General Requirements) to allow for the replacement of the existing pylon in anon-conforming location; and WHEREAS, this property is addressed as 3110 Cleveland Avenue, and legally described as: LOT 1, EXCEPT THE EAST 43.0 FEET, AND THE NORTH 15.0 FEET OF LOT 2, EXCEPT THE EAST 43.0 FEET, BLOCK 1, ROCAT'S ADDITION PIN: 04-29-23-22-0001 WHEREAS, Section 1005.01 requires a minimum 30-foot setback for structures (e.g., pylon signs) from public rights-of--way; and WHEREAS, Section 1012.03 requires a minimum 40-foot "visibility triangle" at intersections; and WHEREAS, Croix Oil Company seeks to construct a pylon sign within the required "visibility triangle"; and WHEREAS, the Planning Division has concluded that "hardships" are present and support can be given to deviate from the strict requirements of the Roseville City Code if the conditions identified below are met;
