ALSO EXCEPTING the part of Lot 1, Block 1, Hillsborough overlying Lots 11 and <br />12 including that part of adjoining Bismark Avenue vacated and including that part <br />of the South'/2 of the adjoining alley vacated lying Westerly of the extension across <br />said avenue and said alley of the East line of said Lot 11, and Lots 26 and 27 <br />including that part of the North 1/z of the adjoining alley vacated lying Westerly of <br />the extension across said alley of the East line of said Lot 27, all in Block 8, Rice <br />Street Grand View Addition to St. Paul. <br />Abstract Property. <br />Being registered land as is evidence by Certificate of Title No. 355367. <br />WHEREAS, Section 1018.05(C)4 (Intersection) requires a 40-foot driveway <br />setback from the right-of--way line of a street intersection; and <br />WHEREAS, Cave & Associates seeks to construct a parking lot entrance 32.5 feet <br />from the right-of--way line, a 7.5-foot variance; and <br />WHEREAS, the Planning Division has concluded that "hardships" are present and <br />support can be given to deviate from the strict requirements of the Roseville City Code; <br />NOW THEREFORE BE IT RESOLVED, by the Roseville Variance Board, to <br />APPROVE a 7.5-foot VARIANCE from the required intersection setback Section <br />1018.05 (Design and Maintenance of Parking and Loading Areas) of the City Code. The <br />VARIANCE shall expire 6 months after the approval date if a building permit is not <br />issued pursuant to § 1013.03 of the City Code. <br />The motion for the adoption of the foregoing resolution was duly seconded by <br />Member Wozniak and upon vote being taken thereon, the following voted in favor: <br />Members; Bakeman, Boerigter, and Wozniak; <br />And none voted against; <br />WHEREUPON said resolution was declared duly passed and adopted. <br />Page 2 of 3 <br />
