5.0 STAFF RECOMMENDATION 5.1 Staff recommends approval of the PUD Amendment (#1199) allowing Taco Bell to install a 20 square foot sign on the north fa�ade consistent with the attached sign plan and to e�tend the drive-thru hours of operation only from 9:00 a.m. to 2:00 a.m. weekdays and weekends, subject to a review in December of 2001 and 2002, to be reviewed by the City Council with appropriate action taken. 6.0 PLANNING COMMISSION CONSIDERATION/ACTION 6.1 On February 14, 2001, the Roseville Planning Commission held the public hearing regarding Border Foods PUD Amendment request. At this hearing Peter Anderson indicated his residential neighborhood (California Avenue, St. Paul) is not opposed to the added sign. However, he and his neighbors oppose a weekday expansion of late night hours. Mr. Anderson indicated a concern of increased late night bar traffic in the area where a number of elderly residents and families with children live. 6.2 The Planning Commission asked general questions of staff, 7im Erickson (Border Foods) and Mr. Anderson, for which the received answers (see attached minutes). 6.3 The Planning Commission recommended (5-O) to approve the request by Heritage Realty Management, Inc and Border Foods to amend Planned Unit Development #1199 allowing an additional 20 square foot sign on the north facade and increased hours of operation for the drive-thru onlv until 2:00 a.m. weekdays and weekends for the Taco Bell, 110 1 Larpenteur Avenue, with an annual (two year) review in December 200 1 and 2002 by the City Council with appropriate action taken. 7.0 SUGGESTED COUNCII, ACTION 7.1 By motion waive frst reading and adopt (adopt with modifications or deny) the attached ordinance amending Planned Unit development Agreement #1199 for properiy located at 110 1 Larpenteur Avenue, allowing Taco Bell to install an additional 20 square foot sign on the north building face and to increase the hours of operation for the drive-thru service only from 9:00 a.m. to 2:00 a.m., conditioned on annual (two year) review in December 2001 and 2002 by the City Council with appropriate action taken, (ordinance attached). 7.2 Should the Council not reach a consensus on either of the requested items, it is recommended that they e�tend the 60-day review deadline an additional 60-days.
