A pathway easement, running along a majority of the eastern properiy line <br />adjacent the access road, necessary because of the required path location. <br />3.0 POLICY & FISCAL IlVIPLICATIONS <br />3.1 There are no policy or fiscal implications. <br />4.0 STAFF COMIV�NTS & RECOMMENDATION <br />4.1 This is a record keeping issue that has no impact on the land use or the utility system. <br />4.2 The Engineering Department has reviewed, provided comments, and approved the <br />necessary vacation and dedications. All documents must be recorded prior to the <br />issuance of a certificate of occupancy for the Sunrise facility. <br />4.3 Based on the findings in Section 4.1 and 42, staff recommends approval of the utility <br />easement vacation and dedication of necessary utility, drainage, and pathway easements <br />of the property at 2555 Snelling Avenue. <br />5.0 PLANNING C01�T1�TISSION ACTION <br />S.1 On April 14,200 1 the Planning Commission recommended that the easement be vacated; <br />the easements necessary for the provision of storm water management and pathway <br />facilitation be accepted; and that the City Council hold the public hearing to efficiently <br />expedite the request. <br />6.0 SUGGESTED COUNCII, ACTION <br />6.1 By motion approve (approve with modifications or deny) the request by Sunrise <br />Assisted Living to vacate a specific utility and drainage easement (attached); and <br />6.2 By motion accept the provision of new utility, drainage, and pathway easements. <br />Prepared by: Thomas Paschke <br />Attachments: site plan of easements. <br />PF3292 RCA (OS 140 1) - Page 2 of 2 <br />
