Lessee agrees that communication via telephone or facsimile with Owner's Contact Person sha11 in no way satisfy the notice requirements set forth in other provisions of this Lease, unless those provisions expressly a11ow verbal or facsimile notification as an acceptable means of fulfilling Lessee's notification obligation. 19. Representations and Warranties. (a) Owner represents that (i) it has full right, power, and authority to execute this Lease and (ii) it has good and unencumbered title to the Properiy free and clear of any liens or mortgages. Owner warrants that Lessee sha11 have quiet enjoyment of the Property during the term of this Lease in accordance with its terms. ((�) Lessee represents and warrants that its use of the Premises, herein, will not generate and it will not store or dispose on the Property nor transport to or over the Property any hazardous substance. Lessee further agrees to hold Owner harmless from and indemnify against the release of any such hazardous substance and any damage, loss, or expense or liability resulting from the breach of this representation or from the violation of any state or federal law by Lessee, including a11 attorneys' fees, costs and penalties incurred as a result thereof, other than such materials used in the ordinance course of Lessee's wireless telecommunications business in accordance with all applicable Laws and Regulations. "Hazardous substance" shall be interpreted broadly to mean any substance or material defined or designated as hazardous or to�c waste, hazardous or to�c materials, hazardous or to�c or radioactive substance, or other similar term by any federal, state or local environmental law, regulation or rule presently in effect or promulgated in the future, as such laws, regulations or rules may be amended from time to time; and it shall be interpreted to include, but not be limited to, any substance which after release into the environment will or may reasonably be anticipated to cause sickness, death or disease. Notwithstanding anything to the contrary contained in this Lease, Owner agrees that Lessee may use or store sealed batteries and/or generators on the Site for use in connection with Lessee's Communications Facilities, together with sma11 amounts of customary cleaning supplies, all handled in accordance with a11 applicable laws. (c) Owner represents that Owner has no knowledge of any substance, chemical, or waste on the Owner's Properiy that is identified as hazardous, toxic or dangerous in any applicable federal, state or local law or regulation. 83831 g
