REQUEST FOR CITY COUNCL ACTION <br />D A T E: O6/26/01 <br />ITEM NO: �_,� <br />CONCENT <br />Item Descri�iEion: A request by John Overbye for a 20-foot Variance from Section 703.04B1a <br />of the Roseville City Code for property located at 2916 West Owasso <br />Boulevard (PF33041 <br />1.0 REQUESTED ACTION <br />1.1 7ohn Overbye is requesting a 20-foot variance from Section 703.04B la of the City Code <br />to allow a driveway apron in the public right-of-way to be increased from the required <br />26-foot maximum width to a width of 46 feet. <br />2.0 BACKGROUND <br />2.1 Mr. Overbye owns the properry located at 29 16 West Owasso Boulevard. The properry <br />is zoned R-1, Single Family Residential, and the Comprehensive Plan identifies the <br />properiy as Low Density Residential. <br />2.2 The City's Pa�ement Management Program and the reconstruction of West Owasso <br />Boulevard have prompted the variance request. <br />2.3 The proposed reduction of this setback will enable NIr. Overbye to retain his driveway in <br />appro�mately the same location. <br />APRON �VIDTH <br />Code Requirement Current �Vidth Applicant Request Variance Requested <br />26 feet 46 feet 46 feet 20 feet <br />3.0 STAFF COMIV�NT & FINDINGS <br />3.1 Section 703.04B 1 a requires a maximum driveway width of 26 feet in a public right-of- <br />way. Based on the proposal a variance is necessary to allow the existing driveway to <br />remain. <br />3.2 Section 1013.02 requires the applicant to demonstrate a physical hardship and to <br />demonstrate that no practical alternatives exist that would reduce the need for a variance. <br />3.3 Variances may be granted where the strict enforcement of the literal provisions of the <br />ordinance would cause "undue hardship". The granting of a variance sha11 only occur <br />when it can be demonstrated that such an action will be in keeping with the spirit and <br />intent of the ordinance. <br />3.4 "Undue hardship" as used in connection with the granting a variance means the properiy <br />in question cannot be put to a reasonable use if used under conditions allowed by the <br />official controls, the plight of the land owner is due to circumstances unique to the <br />properiy not created by the land owner, and the variance, if granted, will not alter the <br />essential character of the locality.
