REQUEST FOR CITY COUNCIL ACTION <br />DATE:06/26/01 <br />� <br />ITEM NO: J <br />Manager Approved: � � Agenda Section: <br />C(�NSENT <br />Item Descrlption: A request by Steven Marchek for an 1&foot Variance from Section 703.04B4 of the <br />Roseville City Code for property located at 2995 West Owasso Boulevard (PF3306) <br />1.0 REQUESTED ACTTON <br />l.l Steven Marchek is requesting an 1 8-foot variance from Section 703.04B4 of the City Code to <br />allow a driveway apron (in the public right-of-way) to be within the required setback from a street <br />corner property line. Mr. Marchek's current driveway is located 12 feet from the property line <br />adjacent to Brenner Avenue and the Code requires a setback of 30 feet. <br />2.0 BACKGROUND <br />2.1 Mr. Marchek owns the property located at 2995 West Owasso Boulevard. The property is zoned <br />R- 1, Single Family Residential, and the Comprehensive Plan identifies the properiy as Low <br />Density Residential. <br />2.2 The City's Pavement Management Program and the reconstruction of West Owasso Boulevard <br />have prompted the variance request. <br />2.3 The proposed reduction of this setback will enable Mr. Marchek to retain his driveway in its <br />current location. <br />DRIVE�VAY SETBACK <br />CORNER LOT <br />Code Requirement Current Setback A licant Re uest Variance Re uested <br />30 feet 12 feet 12 feet 18 feet <br />3.0 STAFF COMMENT & FINDINGS <br />3.1 Section 703.04B(4) requires a maximum driveway setback of 30 feet from a property line (corner <br />lot) adjacent to a street right-of-way. Based on the proposal a variance is necessary to allow the <br />existing driveway to remain. <br />3.2 Section 1013.02 requires the applicant to demonstrate a physical hardship and to demonstrate that <br />no practical alternatives exist that would reduce the need for a variance. <br />3.3 Variances may be granted where the strict enforcement of the literal provisions of the ordinance <br />would cause "undue hardship". The granting of a variance shall only occur when it can be <br />demonstrated that such an action will be in keeping with the spirit and intent of the ordinance. <br />PF3306 RCA (062601) Page 1 of 2 <br />
