REQUEST FOR CITY COUNCIL ACTION <br />DATE: 06/26/01 <br />ITEM NO: C— 6 <br />D p ent Approval: Manager�p��oved: Agenda Secrion: <br />CONSENT <br />Item DeSCrlptlon: A request by John Jakel for a 36-foot Variance from Section %�3.�4B�a of the <br />Roseville City Code for property located at 3170 West Owasso Boulevard (PF3307� <br />1.0 REQUESTED ACTION <br />l.l John Jakel is requesting a 36-foot variance from Section 703.04B1a of the City Code to allow a <br />driveway apron in the public right-of-way to be increased from the required 26-foot maximum <br />width to a width of 62 feet. <br />2.0 BACKGROUND <br />2.1 Mr. Jakel owns the property located at 3 170 West Owasso Boulevard. The property is zoned R-1, <br />Single Family Residential, and the Comprehensive Plan identifies the property as Low Density <br />Residential. <br />2.2 <br />2.3 <br />The City's Pavement Management Program and the reconstruction of West Owasso Boulevard <br />have prompted the variance request. <br />The proposed reduction of this setback will enable Mr. Jakel to retain his driveway in <br />approximately the same location. <br />APRON WIDTH I- I <br />Code Re uirement Current �Vidth <br />26 feet 62 feet <br />3.0 <br />3.1 <br />3.2 <br />STAFF COMMENT & FINDINGS <br />�t Re uest Variance Re <br />62 feet 36 feet <br />Section 703.04B 1 a requires a ma�mum driveway width of 26 feet in a public right-of-way. <br />Based on the proposal a variance is necessary to allow the e�sting driveway to remain. <br />Section 1013.02 requires the applicant to demonstrate a physical hardship and to demonstrate that <br />no practical alternatives exist that would reduce the need for a variance. <br />3.3 Variances may be granted where the strict enforcement of the literal provisions of the ordinance <br />would cause "undue hardship". The granting of a variance shall only occur when it can be <br />demonstrated that such an action will be in keeping with the spirit and intent of the ordinance. <br />3.4 "Undue hardship" as used in connection with the granting a variance means the property in <br />question cannot be put to a reasonable use if used under conditions allowed by the official <br />controls, the plight of the land owner is due to circumstances unique to the property not created by <br />the land owner, and the variance, if granted, will not alter the essential character of the locality. <br />Specifically to this request: <br />PF3307 RCA (062601) Page 1 of 2 <br />
