EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF ROSEVILLE Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, County of Ramsey, Minnesota, was held on the 26th day of June 2001, at 6:30 p.m. The following members were present: and the following were absent: Council Member introduced the following resolution and moved its adoption: RESOLUTION NO. A RESOLUTION DENYING JAMES TELSTAD VARIANCES TO SECTIONS 1004.O1A3 (DETACHED ACCESSORY BUILDING SIZE LIMIT), 1004.O1A4 (REQUIREMENTS FOR INCREASED MAXIMUM SIZE), 1004.O1A5 (OVERALL AREA), 1004.O1A6 (MAXIMUM TOTAL SURFACE AREA), AND 1004.O1A8 (MINIMUM SETBACKS) OF THE ROSEVII,LE CITY CODE (PF 3310). WHEREAS, James Telstad has requested a variance to replace an existing accessory building that lies one foot from the property line; and WHEREAS, Mr. Telstad is the owner of properiy located at 2993 Fairview Avenue, legally described as: Lot I, Rohleder's Oak Grove, Ramsey County, Minnesota (PID 042923240025. WHEREAS, the Community Development Staff has determined that variances from Sections 1004.O1A3, 1004.O1A4, 1004.O1A5, 100�1.O1A6, and 1004.O1A8 of the Roseville City Code are necessary in order to allow the accessory building; and WHEREAS, the Community Development Staff has received incomplete information regarding Mr. Telstad's intentions enabling staff to thoroughly consider the ramifications of replacing the small accessory building and determine whether there are unique circumstances or hardships present to warrant granting the identified variances; and WHEREAS, the Roseville Planning Commission held the public hearing regarding Mr. Telstad's request and recommended (6-0) to deny the request based on the findings indicated in Section 6 of the project request dated June 13, 2001; NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to deny the request by James Telstad for variances to Section 1004.0 lA3 (Detached Accessory Building Size Limit), 1004.O1A4 (Requirements for Increasing Maximum Size), 1004.0 lA5 (Overall Area), 1004.O1A6 (Ma�mum Total Surface Area), and 1004.O1A8 (Minimum Setbacks) based on the findings indicated in Section 6 of the project report dated June 26,200 1. The motion for the adoption of the foregoing resolution was duly seconded by Council Member and upon vote being taken thereon, the following voted in favor: and the following voted against the same: WHEREUPON said resolution was declared duly passed and adopted. 1
