REQUEST FOR COUNCIL ACTION <br />DATE: 07/09/0 1 <br />ITEM NO.: C— 2 <br />Department Approval: 1�Ianager Reviewed: Agenda Section: <br />Consent <br />Item Description: Approve an Agreement between the City of Roseville and Lewis Anderson, <br />for the installation of a fence over an utility easement at 1705 Roselawn <br />Ave W. <br />Background: Lewis Anderson, the property owner at 1705 Roselawn Ave West, is interested in <br />enclosing his property with a fence. The property has 66 feet of unimproved right-of-way for <br />Aldine Street adjacent to the east property line, as well as a utility easement running through the <br />backyard. The fence, as proposed, would enclose the backyard making it difficult to access this <br />sanitary sewer line. <br />Staff has reviewed the fence proposal and has determined it would be appropriate to approve the <br />construction as long as an encroachment agreement is entered into with the property owner. This <br />agreement delineates responsibilities related to the proposed encroachment. <br />Policy Objectives: It has been past practice for the City to enter into an encroachment <br />agreement with property owners on these matters. Filing the agreement against the property <br />eliminates any question of the e�stence of the encroachment in the event the City ever needs to <br />use their easement for public purposes. <br />RECOMMENDED COUNCIL ACTION: <br />Approve the Encroachment Agreement for 1705 Roselawn Avenue W. <br />Prepared by: Debra Bloom <br />
