(reserved for recording information) <br />ENCROACHMENT AGREEMENT <br />AGREEMENT made this day of , 2001, by and between the <br />CITY OF ROSEVILLE, a Minnesota municipal corporation ("City"); and LEWIS AMDERSOM <br />and RACHEL BROWN, ("Anderson and Brown"). <br />1. BACKGROUMD. Anderson and Brown are the fee owners of certain real <br />property located in the City of Roseville, County of Ramsey, State of Minnesota, legally <br />described on the attached Exhibit "A" and having a street address of 1705 ROSeldwn Avenue <br />West, Roseville, MN ("subject property"). The City owns an easement for drainage and utility <br />purposes over part of the subject property, currently in use for a sanitary sewer line. <br />Anderson and Brown want to construct a fence on the subject property that would encroach <br />on the City's easement. <br />2. EMCROACHMEMT AUTHORIZATIOM. The City hereby approves the <br />encroachment on its easement for the construction of a fence, conditioned upon the <br />installation of movable or removable fence panels in areas where the fence encroaches on <br />existing utilities.
