July 3, 2001 <br />TO: Neal Beets, Roseville City Manager <br />Ethics Commission <br />FROM: Mayor John Kysylyczyn <br />RE: Correction and clarification of documents transferred <br />June 27, 2001 to the Ethics Commission <br />EthICS complaint: City staff and elected official lobbying in <br />support of a specific position on a Legislative bill in absence of <br />Council discussion and action <br />At the June 26, 2001, Roseville City Council meeting, I gave three items to Mr. <br />Burrell for referral to the Roseville Ethics Commission. In his June 27, 2001 memo, <br />only two of those items were actually referred. <br />Under Section 2 of the Roseville Ethics Resolution, the following individuals fall <br />under the definition of the term "Public Official", and therefore are under the <br />jurisdiction of the Ethics Commission: Council Member Dean Maschka, City <br />Attorney Joel Jamnik, Finance Director Ed Burrell, and former City Manager Steve <br />Sarkozy. <br />The third item discussed at the City Council meeting still requires referral to the <br />Ethics Commission. That particular issue was raised in Mr. Lambert's letter to the <br />Commission of June 22, 2001 and involves the above-mentioned individuals. <br />In the spirit of full cooperation with the process underway, I believe the following <br />statements are true and not frivolous. <br />As Mr. Lambert states in his letter, City Manager Steve Sarkozy, Finance Director <br />Ed Burrell, Council Member Dean Maschka and City Attorney Joel Jamnik met with <br />Senators John Hottinger and Sandra Pappas during the 2000 Legislative Session <br />on a change in Tax Increment Financing rules contained in the Omnibus Tax bill <br />(this is the same bill and specific provision for which I am accused of unethical <br />behavior). <br />While each of these individuals is a citizen (as am I) and therefore has the right to <br />lobby on any issue which interests them (as do I), they met the named senators as <br />a group, purportedly representing the City of Roseville, and lobbied for a specific <br />outcome for the legislation. No public meetings had been held regarding this issue, <br />the City Council had not discussed the issue as a body, and certainly had not voted <br />any position on this issue before the group's appointment with the Senators. In <br />other words, the lobbying done by them could not and did not carry the authority of <br />the Council, and as such exceeds the individual authorities of those citizens. This is <br />
