9.6 Off-Street Parking Lot Setbacks. The minimum setback adjacent to Lincoln Drive <br />shall be established at 15 feet and the setback adjacent to Snelling Avenue shall be <br />established at _ feet (Plan A). <br />9. 7 Building Height. The office complex shall not exceed a height of 32 feet for the <br />main portion of the building, 38 feet for the entry/clerestory portion of the <br />building, 64 feet for the elevator and mechanical tower, and 81 feet for the radio <br />antenna. The antenna shall be mounted directly to the elevator/mechanical tower. <br />The addition of a third floor shall require a formal amendment to this PUD and <br />this Agreement (Plan G,1-4). <br />9.8 Building Design & Materials. The structure is a contemporary collegial design, <br />which incorporates the use of brick, stone, metal, and stainless steel into the <br />facade. Final building materials must be reviewed and approved by the <br />Community Development Director or designee before issuance of any building <br />permits (Plan C� 1-4). <br />9. 9 Mitigation of Impact on Adjacent Residential Uses. All e�terior I-IVAC <br />mechanical units shall be interior or rooftop units fully (100%) screened from <br />view of property lines. <br />9.10 '1 ree Preservation. All e�sting trees located along Lincoln drive and Snelling <br />Avenue, except those located within 30 feet of the office pad, must be preserved <br />and protected during construction (Plan E). <br />9.11 �S'ite Fencing. The silt fencing (erosion control fencing) that is to be placed <br />around the construction limits shall be reviewed and approved by the Public <br />Works Director or designee (Plan B). <br />9.12 Site Landscaping. Landscaping for the project shall be comprised of coniferous <br />and deciduous trees, shrubs, and perennials places throughout the site (Lots 1, 2, <br />and 3). All landscape areas, including sod areas, shall be irrigated. The final <br />landscape plan must be prepared by a Minnesota registered landscape architect as <br />per Chapter 1010 of the City Code and reviewed and approved by the Community <br />Development Director of designee (Plan E). <br />9.13 Landscape Letter of Credit. Prior to the issuance of a grading, excavation, <br />foundation, and/or building permit, the DEVELOPER shall provide the CITY <br />with a landscape letter of credit, bond, or other security acceptable to the City, in <br />an amount equal to 150% of the full cost of all landscaping, irrigation, and site <br />restoration (City Code Section 1010.14E). Said letter of credit or bond must be in <br />place for a minimum of three years from the date of issuance. The amount of the <br />letter of credit or other security shall be determined by the Community <br />Development Director or designee, following approval of plans. <br />5 <br />
