Resolution No. 8593 Section 5. Handline Alleged Violations of Code uf Ethics. E'"t;.=� � A. An Ethics Commission is hereby established. The Commission sha11 be composed of three individuals, two of whom sha11 be residents of the City and the third shall be a nonresident. Initial appointments sha11 be for terms of one. t��•o. and three years respectively. Thereafter. appointments sha11 be for three year terms. The City Council sha11 appoint a chairperson and secretary from the Commission membership. Allegations of violations of this code against public officials. except employees who arc subordinate to the City Manager. sha11 be referred to the Ethics Commission for investigation. Allegations which may constitute a violation c�f a federal. state. or local statute sha11 be referred to the appropriate criminal authority. Results of the investigation of the Ethics Commission sha11 be reported to the Cit}� Council along with the Commission's recommendation for disposition. Thereafter. the C'ity Council shall take appropriate action which ma} include censure af a C'ouncil Member, discipline cit City Manager. or no action. The Commission sha11 conduct an organizational meeting during Januaty of each ��ear, and thereafter meet only at the request of the City Council or City Manager. B. Allegations against public officials who are subordinate to the City Manager including the Fire Chief and Assistant Fire Chief. shall be handled by the City Manager. The City Manager may take appropriate disciplinary action against employees violating this code. Section 6. Disclosure of Financial Interests. Not later than ninety (90) days after the date of approval of this code. each public official of the City shall file as a public record, in the office of the City Manager. a statement containing the following: A fist naming a11 business enterprises known by the public official to be licensed by or to be doing business with the City in which the public official or any member of the public official's immediate family is connected as an employee. officer. owner. investor. creditor of. director, trustee, partner. advisor. or consultant; and 2. A list of the public officials and members of the public officials' immediate family's interests in real properiy located in the City or which may be competing «�ith the interests of the Cit} located elsewhere. other than property occupied as a personal residence. Each person who enters upon duty after the date of this code in an office or position as to ��hich a statement is required by this code sha11 file such a statement on forms to be provided by the City not less than thiriy (30) days after the date of his;'her entrance on dut��.
