G�,,..1��' <br />f� <br />August 16, 2001 <br />Ms. Connie Pease, Chairperson and Members of the <br />Roseville Ethics Commission <br />C/o City Manager's Office <br />2660 Civic Center Drive <br />Roseville, �in�esota 55 113 <br />Dear Ms. Pease and Members of the Roseville Ethics Commission: <br />I am pleased to respond to specific questions that you pose related to proposed legislation in the 2000 <br />Session. <br />Specific response to your questions is as follows: <br />Q: Were public funds used and if so, to what extent? Did you bill the City for your time? <br />A The meeting in question occurred during the normal business day, no expenses were incurred. <br />Q: Did you seek an expense reimbursement? <br />A: No. <br />Q: Underwhat public authority were you acting? <br />A: As City Manager, among the broad range of duties, one important role is to monitor and <br />legislation, advise legislative bodies on possible impacts of with the intent on protecting our <br />commuuity's interests. It is/was not unusual for elected officials to inquire about potential <br />legislation or to offer comment as to the possible impact on Roseville. Further, Councilmember <br />DoM Wiski was very involved with legislative issues as then Chairperson of the Transportation <br />Advisory Board and also a member of the Board at the Association of Metropolitan <br />Municipalities (AMIV�. Councilmember Wiski indicated that he had been party to discussions <br />about tlus proposed legislation with AMM. He was to have been at the meeting. <br />Q: Did you go as a representative of Roseville or in some other capacity? <br />A I attended as a member of City staff. <br />Q: `��ho accompanied you? <br />A: As I recall, attending were Councilmember Dean Mascbka, Attomey Joel Jamnik, Finance <br />Director Ed Burrell, and myself. As indicated earlier, Councilmember poM Wiski was also <br />planned to attend. As I recall, he intended to meet at the Capital but a change in his personal <br />schedule and traffic delays caused him to miss this meeting. <br />To further explain my involvement it may be helpful to understand some of the relevant preceding events. <br />While at an out-of-state conference, I received a voicemail from Gene Ranieri, Executive Director of tlte <br />AMM. Mr. Ranieri called to say that he had just met with Representative Dan McElroy. Rep. McElroy <br />indicated to Mr. Rauieri that he had just met with Mayor Kysylyschyn and representative(s) of a developer <br />regarding proposed T'IF legislation and that Mr. Ranieri should call me to advise about its' potential impact. <br />Mr. Rauieri did call me shortly after their meeting. The proposed changes involving TIF had not been the <br />subject of hearings and the usual public process. Efforts by me at the time to identify who had proposed <br />these changes proven unsuccessful. I do not believe that the AMM and League of Cities knew of the <br />proposed changes at tl�e time. The then proposed legislative changes had potentially significant impact on <br />Roseville and other cities. That "heads-up" by Rep. McElroy caused ANIlVI, the City of Roseville, and <br />ultimately the Nlinnesota League of Cities to carefully review the possible impacts of the legislation and <br />advise the Legislature accordingly. <br />
