10. Signage shall be non-lighted, non-flashing, non-moving, and shall not exceed <br />75 s.f. of total signage including the building wall signage and the lawn <br />monument signage. <br />11. The interim use permit shall expire on September 24, 2006, unless an <br />application is submitted for a five year e�tension of the permit in the May, <br />2006. Upon the expiration date of the initial term of the interim use permit, as <br />established by the City Council, the permit shall automatically expire without <br />action of any kind unless the permit is e�tended in accordance with <br />Subsection 11 of this Section. <br />12. Applications for e�tension shall be filed 120 days prior to the expiration date <br />of the original permit, or the expiration of any e�tension thereof. Unless the <br />original permit was expressly declared to be nonrenewable, the interim use <br />permit may be e�tended for additional terms of not more than five (5) years <br />each if the City Council makes all of the findings set forth in this resolution at <br />of the time of each renewal. The City Council shall be the approving authority <br />for any or all e�tensions of the permit. The Council may refer the application <br />for e�tension to the Planning Commission for study and recommendations <br />action thereon if the Council determines that special problems or <br />circumstances may exist with regard to the proposed e�tension. There is no <br />vested right or legal entitlement to an e�tension and the decision on any <br />application for e�tension shall be within the sole discretion of the City <br />Council. <br />13. The City Council shall, in all cases, retain continuing jurisdiction over each <br />such permit and may, at any time, either on its own initiative or in response to <br />a violation of the terms of the permit, modify or delete any conditions of the <br />permit or impose any new conditions if necessary in order to preserve the <br />public health, safety and welfare, or to prevent the creation or continuance of <br />a public nuisance, or where such action is necessary to preserve or restore any <br />of the findings set forth in this resolution. Prior to Council action, the <br />Planning Commission shall conduct a public hearing on the proposed <br />modification to the permit conditions and notice thereof shall be given in the <br />same manner as prescribed in Section 108 and Section 10 12. <br />14. Violations of the terms of this Interim Use Permit shall be considered grounds <br />for revocation of the Interim Use Permit at any one time or grounds for denial <br />of a permit e�tension to a further five year period. An interim use permit may <br />be revoked upon a determination by the City Council that the holder of such <br />permit has failed to comply with any of the conditions thereof or has violated <br />any applicable provision of the City Code. Prior to Council action, the <br />Planning Commission shall conduct a public hearing on the revocation and <br />notice thereof shall be given in the same manner as prescribed in Section 108 <br />and 1012. <br />--Q:CommDevlPianning Filesl3329/RPCA-DraftRes(091201) <br />4 <br />
