The plight of the landowner is due to circumstances unique to the propeNty not <br />created by the landowner: The property is a comer lot that is given limited <br />development options within the front yard. In the case of the Freeman parcel, the <br />front yard is Huron Street; however, the principal structure, detached accessory <br />building, and the properties address result in a perceived front yard of Woodhill <br />Drive. The uniqueness of this property and the limited fle�bility of the City <br />Code to deal with situations similar to that of the Freeman's have contributed to <br />the need for a variance <br />C. The variance, if granted, will not alter the essential character of the locality: <br />The proposed height variance will not alter the essential character of the locality, <br />nor adversely affect the public health, safety, or general welfare, of the city or <br />adjacent properties. <br />5.0 STAFF REC01�'I1�'IENDATION <br />5.1 Based on the comments and findings outlined in Section 3 and 4 of this report, staff <br />recommends approval of the request for a two foot height variance to Section <br />1012.02B2 of the City Code, to allow the construction of a six foot tall fence in a <br />portion of the front yard of property located at 1296 Woodhill Drive. <br />6.0 PLANNING C01��I1��IISSION REC01��I1��IENDATION <br />61 Planning Commission excerpt from Draft Minutes of September 12, 2001: <br />A request by Clinton Freeman, 1296 Woa�l/atll Drive, for a variance to Section IO1l.0iB2 of the <br />Roseville Crty Code for allowance of a fence in a fYOnt yard greater than four feet. <br />Chair Jim Mulder opened the hearing and requested Dennis Welsch to provide a verbal summary <br />of the project report dated September 12, 2001. <br />Dennis Welsch explained that Mr. Freeman owns the home located at I296 WOOdhill Drive. The <br />property is zoned R-1, Single Family Residential Distr°ict with a Comprehensive Plan Designatz�on <br />of LR, Low Density Residential. The Freeman property is surrounded by residential homes on the <br />north, south, east, and west. To the southeast lies Howard Johnson Park. The request includes a <br />varlance fi'om Section 1012.02B2 of the Roseville Zoning Ordinance to increase the height of a <br />fence in a front yard to six feet, The Freeman lot is a corner lot with frontage along Woodh111 <br />Drive and Huron Str°eet. The Freeman home is addressed of�' of Woodh�ll Drive, which under City <br />Code is a side yard The fi°ont yard as prescribed by the City Code, is that which fronts along <br />Huron Str°eet. In the case of the Freeman 's the true front yard is used as a side yard. The <br />Freemans desire privacy and sound screen for their home and would like to constr°uct a six foot <br />tall fence f►'om their south property line to the home. The fence would be set back approximately <br />nine feet from the front property line adjacent to Huron Street. <br />Based on the comments andfindings outlined in Section 3 and 4 of the project report, staff <br />recommended approval of the request for a two foot height variance to Section 1012.02Bi of the <br />PF3341- RCA (092401).doc Page 3 of 4 <br />
