EXTRACT OF A�IINUTES OF 1�IEETING <br />OF ROSEVJLLE CITY COUNCIL <br />Pursuant to due ca11 and notice thereof, a meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was duly held on the 24�' day of September, <br />2001, at 6:30 p.m. <br />The following members were present: Maschka, Mastel, Klausing Goedeke and <br />Kysylyczyn <br />and the following members were absent: None <br />Member Maschka introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 9939 <br />RESOLUTION APPROVING AN INTERII�T USE PERI�TIT FOR THE FAI�TILY <br />ACADEI�IY CHARTER SCHOOL AND ADVENT LUTHERAN CHURCH TO ALLO`�� <br />OFFICES AS A THREE YEAR INTERII�T USE AT 3000 HAMLINE AVENUE (PF3336) <br />WI�REAS, Family Academy Charter School has requested an interim use permit to <br />allow the placement of an office for administrative use at 3000 Hamline Avenue Avenue, and <br />WI�REAS, Section 1012.09A states: the City Council may authorize an interim use permit of <br />property. Interim use may not be consistent with the land uses designated on the adopted Land <br />Use Plan. They may also fail to meet all of the zoning standards established for the district within <br />which it is located, the term "interim use" generally means a use that is not expressly authorized <br />in the City Code, or any other regulations applicable to an area or any portion thereof, provided <br />such use is not an expressly prohibited use as described in Section 1004 ("R-1" Single Family <br />Residential Zone) of the City Code; and <br />WI�REAS, the Planning Commission has recommended, on the basis of the application <br />and the evidence submitted, the following findings: <br />L That the proposed 12' x 56' wood sided modular office interim use and the <br />conditions under which it would be operated will not be detrimental to the public <br />health, safety or welfare, or injurious to properties or improvements in the vicinity; <br />2. The proposed office interim use will not create any significant unmitigated adverse <br />environmental impacts, <br />3. The proposed office interim use will not obstruct, interfere with use of the property in <br />accordance with the uses anticipated in the comprehensive plan or any other adopted <br />specific plan applicable to the site; <br />4. All public utilities and other infrastructure improvements required in order for the <br />office interim use to be conducted in a safe, sanitary, and lawful manner are either <br />a�ailable at the site or shall be installed by the applicant, prior to occupancy, in a <br />manner approved by the city engineer and building/fire staff; <br />S. The use will provide either or both of the following benefits: <br />a. A benefit to the property as the installation of improvements and occupancy <br />will facilitate continued use of the site, and/or <br />b. A benefit to the public, such as the creation of jobs, revenues, and the <br />provision of needed school services, and <br />
