Planned Unit Development process (located in Exhibit S), the DEVELOPER has not defaulted, and <br />all of the standards and conditions of this agreement have been satisfied. <br />For three (3) years from the date of this Agreement, no amendments to the CITY' S Comprehensive <br />Guide Plan or official controls sha11 apply to or affect the use, development density, site layout, or <br />dedication requirements of the land included within the Planned Unit Development unless required <br />by state or federal law or agreed to in writing by the CITY and the DEVELOPER. For any <br />improvements proposed thereafter, notwithstanding anything in this Agreement to the contrary, the <br />CTTY may require compliance with any amendments to the City's Comprehensive Guide Plan, <br />official controls, platting or dedication requirements enacted after the date of this Contract. <br />4.0 Approval by the CITY <br />In approving the final development plan for the PUD for Roseville Estates Mobile Home Park, the <br />CITY hereby incorporates the following exhibits. The DEVELOPER sha11 develop the subject <br />property as described or shown in these e�ibits. If the e�ibits vary from the written terms of this <br />Agreement, the written terms shall control. In the event the e�ibits address items not specifically <br />addressed in this agreement, the exhibits sha11 govern with respect to those items. The e�ibits <br />approved as part of the PUD by the City Council on October 22,200 1, or as amended thereafter, <br />include: <br />PUD EXHIBITS <br />Exhibit A Certificate of Survey and legal description of the properiy <br />Exhibit B Final Site Plan with all concepts and plans for improvements. Dated: <br />September 13,200 1. <br />Exhibit D Landscape Plan with materials list, sizes, and locations of a11 plant materials. Dated: <br />September 13, 2001. <br />Exhibit E Improvements Plan with locations and a11 dimensions, new double-wide building <br />footprints or pads, lighting, waste enclosures including identification of building <br />materials, and signage plan, identifying a11 proposed signage. Dated: <br />September 13,200 1. <br />Exhibit F Parking lot plan illustrating , as well as all e�sting and proposed paved parking <br />spaces, parking curbs, storage areas, sidewalks, and future expansion of parking <br />spaces.
