Mr. Telstad uses the <br />shed to store a snow hlower and other vard/�arden items and he desires to renlace the <br />- - - - - -- ---- - --- <br />shed given its age versus placing a new roof over the structure. The one allowable garden shed shall not be considered an accessory building. <br />3.3 The proposed 10 foot by 10 foot (100 square foot) garden shed meets the requirements of <br />Section 1004.01 A2 of the Roseville City Code. <br />3.4 Section 1004.O1A8 reads as follows: Minimum Setbacks: A garden shed andlor an <br />accessory building shall be set back a minimum of 5 feet from a side yard or a rear yard <br />lot line and a minimum of 6 feet from any other building or structure on the same lot or <br />parcel. <br />3.5 Because the existing garden shed lies within (2-1/2 feet) the required fve foot side yard <br />setback the shed has been determined to be non-conforming to Section 1004.41 A8 for <br />just the side yard setback and requires a variance to be replace in the same location. <br />4.0 STAFF VARIANCE FINDINGS <br />4.1 Section 1013.02 requires the applicant to demonstrate a physical hardship and to <br />demonstrate that no practical alternatives exist that would reduce the need for a variance <br />4.2 Variance may be granted where the strict enforcement of the literal provisions of the <br />ordinance would cause "undue hardship".
