REQUEST FOR COUNCIL ACTiON <br />DATE: 11 /26/01 <br />ITEM NO.: F-4 <br />Department ApprovaL• Manager Reviewed: Agenda Section: <br />�� Reports/Recommendations <br />Item De�ription: Approval of earnest money contract for easement needed for <br />City Project 99-14: Larpenteur Avenue Reconstruction and Streetscape <br />Background: In conjunction with the reconstruction of Larpenteur Avenue, the City of Roseville worked <br />with Ramsey County on plan development. All survey and base mapping was provided by the County. <br />When plans were first developed in 1999, we were unable to obtain an easement from Solar Car Wash, <br />1315 Larpenteur Avenue. As a result, the plans were finalized with all improvements within the right-of- <br />way. <br />After construction, the property owner and City staff had concerns about the exact location of the right-of- <br />way in relationship with the new sidewalk. We asked the County Surveyor to verify property corners, <br />after this field verif'ication, it was apparent that there was a problem with the base map. Upon further <br />review of the plan and field located property lines, we determined that instead of the 12 feet shown on the <br />base maps, we only had 9 feet. This placed a portion of the sidewalk on private property. We have been <br />working with the property owner since July to obtain an easement for the encroachment. Last week we <br />were able to acquire a 1 foot permanent easement, with an 8 foot temporary construction easement. <br />Additional compensation was also given for the Gottfried Pit fence that connects to the existing fence on <br />the Soler Car wash property. <br />Policy objectives: For reconstruction projects within the City of Roseville, we normally acquire <br />easements prior to construction. It is unfortunate that this did not occur on this occasion. These <br />easements are between the property owner and the City of Roseville. <br />Financial implications: This easement was identified after construction.
