Section 42 Pension -10 Years in Association - 20 Years Roseville Fire <br />Department <br />Anyone who has been a member of this Association for at least ten (10) years and who <br />has served twenty (20) years in the Roseville Fire Department and who has reached the <br />age of fifty (50) years, may make application to the Board of Trustees for a service <br />pension and receive the service pension hereafter set out, providing the application <br />therefor is received by the Board of Trustees not later than sixty (60) days after the <br />applicant retired from service. <br />This service pension may be increased or decreased by the Board of Trustees from time <br />to time within the limits set herein and in accordance with Minnesota law and the <br />provisions of these Bylaws. The applicant for such service pension shall release this <br />Association from any and all claims and payment of benefits except the sum established <br />for such pension. Neither said years of service nor said years of inembership need be <br />consecutive; however, time while on leave of absence and time under suspension shall <br />not be included in determining total time preconditions for pension benefits. <br />Upon the death of such Pensioner, the Surviving Spouse shall continue to receive the <br />service pension so long as the spouse does not remarry. In the event that such <br />Pensioner does not leave a surviving spouse, then the balance of the service pension <br />benefits to which such Pensioner was entitled shall be payable as limited herein to the <br />surviving minor child or pro rata to the surviving minor children. The Pension benefits <br />payable to such surviving minor child or minor children in the event that there was no <br />Surviving Spouse of the deceased shall continue during said child or children's minority. <br />The Board of Trustees when acting as the Board of Trustees, is hereby authorized to <br />direct payment of said service pension provided that all qualifications are met as set forth <br />herein. <br />All applications for benefits must include a certified copy of the death certificate of the <br />pensioner. <br />Section 42A Post-Retirement Increases <br />Whenever the amount of the service pension per year of service credit is increased for <br />active members of the Association upon their qualification therefor, the amount of the <br />service pension payable to each Pensioner or other retirement benefit recipient receiving <br />a service pension as of January 1, 1980 and thereafter, may be increased by the same <br />amount per year of service credit. <br />Section 43 Monthly Service Pension <br />The monthly service pension payable to an eligible retiring member shall be equal to the <br />Maximum Service Pension determined by reference to Minnesota Statutes §424A.02 <br />Subd. 3 based upon the average amount of available financing per active covered <br />firefighter determined on or before August 1 st of each year as provided by Section 25 <br />herein. <br />Payment of all service pensions (monthly, lump-sum and deferred) shall commence on <br />the First (15t) day of the month next following approval of the application by the Board of <br />Trustees . <br />Payment shall terminate on the latter of (a) the date of death of the Pensioner, or (b) the <br />date of death or remarriage of the Surviving Spouse; or (c) when no child or children of <br />the Pensioner are minors. <br />10 <br />
