Approval:
REQUEST FOR CITY COUNCIL ACTION
D A T E: 04/22/02
ITEM NO: B
Agenda Section:
CONSENT
Item Description: A request by Paul King for a Minor Subdivision (Re-combination) tv madify
an existing properiy line between Lots 16 ,17,18 Garcelon's Addition, Block
l, 1938 Lake Street (PF3375).
1.0 REQUESTED ACTION
1.1 Mr. Paul King, properiy owner at 1938 Lake Street has requested the City Council
approval of a"Recombination" of three existing lots into two lots, one with an existing
house, and the remaining lot for a new home. The lots are zoned "R-1" Single Family and
the Comprehensive Plan designates the lots for "LDR" Low Density Residential.
1.2 Section 11Q4.04B reads: Recombination: To divide one recorded lot or parcel in order to
permit the adding of a parcel of land to an abutting lot and create two (2) buildable
parcels, the proposed subdivision, in sketch plan form, shall be submitted to the City
Council for approval. No hearing or Planning Commission review is necessary unless the
proposal is referred to the Commission by the Community Development Director for
clarification. The proposed recombination shall not cause any portion of the existing lots
or parcels to be in violation of this regulation or the zoning code. Within thiriy (30) days
after approval by the City Council, the applicant shall supply a certificate of survey to the
Community Development Director and City Manager for review and approvaL After
completion of the review and approval by the Community Development Director and
City Manager, the applicant shall record the survey with the Ramsey County Recorder
within sity (60) days after approval by the City Manager.
1.3 The staff suggested that the setback between the existing home and the new properiy line
be seven feet wide versus the proposed ten feet. The purpose of this lot line change is to
create a wider lot (65 feet wide) onto which a new home could be constructed. It should
be noted that the City Code allows structures in this area of Roseville to be a minimum of
five feet from a properiy line; this distance is too close on this lot with woods and steep
rear slopes. The staff recommended to the applicant to create a 65-foot wide parcel and an
85-foot wide parcel and determine the storm water pond outlet elevation.
1.4 The staff determined that the pond in the rear yard is a storm water pond for which any
structure must be set back a minimum of 20 feet. Further, any structure constructed must
have a lowest floor elevation a minimum of two feet above the pond outlet.
PF3375 - RCA (042202).doc2
