3.0 Staff Comments and Suggested Recommendation <br />3.1 Staff recommends that the City Council focus on the "City Housing Policy" — if it is <br />to ensure the long term viability of the housing stock in the community, ha�ing a <br />Housing & Redevelopment Authority is the best legal authority to do so. The City's <br />e�sting legal authority, with the powers of a port authority, can achieve many of the <br />same obj ectives as an HRA. However, to do many of the existing and future <br />housing projects using the existing City structure requires cross reference <br />statutory authority through blighted land and correction of health, safety and <br />welfare issues. Using an HRA, the statutory authority is very clearly written <br />with the specifc focus on housing projects. <br />3.2 In addition, the " funding sources" and "funding uses" for housing are clarified - an <br />I-IRA has levy authority outside the City levy limits to specifically fu11d housing <br />programs and the administration of those programs. An annual levy must be <br />supported by a budget provided by the HRA and approved by the City Council <br />as part of the budget process as noted in the following excerpt from the MN <br />State Statute 469.033, subd 6- Operation area as taxing district, special tax. <br />...,.. The amount of the levy shall be an amount approved by the governing body of <br />the city, but shall not exceed 0.0144 percent of ta.�ble market value. The authority <br />shall each year formulate and itle a budget in accordance with the budget procedure <br />of the city in the same manner as required of executive departments of the city or, �f <br />no budgets are required to be filec� by August I. The amount of the tax levy fot' the <br />following year shall be based on that budget. <br />3.3 An HRA levy does not need to be instituted immediately.
