B. The plight of � the land owner is due to circumstances unique to the property not <br />created by the land owner: The Vazquez home is unique due to odd setback The <br />home is the only structure on the block and one of few city-wide that is setback <br />25 feet or less from a front property line. The Community Development Staff <br />does not look upon this variance as being created by the property owner, but <br />rather a valid living space addition that has no alternative. <br />C. The variance, if granted, will not alter the essential character of the locality: <br />Many homes from the 1940's were constructed with front porches; however, very <br />few exist in Roseville. The Community Development Staff has determined <br />that the design of the porch will not be out of character or context for a home <br />built in the 1940's. Further, staff has determined that the proposal would <br />not alter the essential character or the locality, nor adversely affect the <br />public health, safety, or general welfare, of the city or adjacent properties. <br />6.0 STAFF RECOMMENDATION: <br />6.1 Based on the information provided and the findings in Section 5 of this project report, <br />staff recommends approval of a 7.5 foot variance from Section 1004.04D5 of the <br />Roseville City Code for Richard Vazquez to allow the construction a 8 foot covered <br />porch on the front of the home at 812 Lovell Avenue, subject to the following conditions: <br />a. The applicant submitting a site plan with the exact measurement the principal <br />structure lies from the front properiy line, which will require locating the front <br />property corner pins. <br />b. The variance not exceeding the dimensions indicated on the submitted site plans <br />or a three foot encroachment from the porch foundation (based on staff analysis <br />this would equal a 7.5 foot variance). <br />c. The review and approval of a building permit consistent with the approved <br />variance and plans. <br />d. The installation of roof gutters to properly direct roof drainage away from the <br />adjacent properties. <br />7.0 PLANNING COMMISSION CONSIDERATION: <br />7.1 On June 5, 2002, the Roseville Planning Commission held the public hearing regarding <br />the Vazquez request. At the hearing, no citizens were present at the hearing to address <br />the Commission. <br />7.2 The Commission voted (5 -- 0) to recommend approval of the Vazquez variance request <br />for a porch addition to encroach into the required 30 foot front yard setback, based on the <br />findings of Section 5 and conditions of Section 6 of the project report dated June 5, 2002. <br />PF3396 • RCA 060502 • Page 3 of 4 <br />
