6.0 STAFF RECOMMENDATION: <br />6.1 Based on the information provided and the findings in Section 5 of this project report, <br />staff recommends approval of a 13 foot variance from Section 1004.02D5 and a variance <br />to Section 602.02 of the Roseville City Code for Robert Wilson to a11ow the replacement <br />of a carport with an attached garage and second story living space at 3 107 West Owasso <br />Boulevard, subject to the following conditions: <br />A The attached garage and living area (above) not encroaching more than 17 feet <br />into the front yard and be a maximum size of 30 feet wide and 26 feet deep. <br />B The driveway (garage) be designed to reduce the slope of the access from West <br />Owasso Boulevard in accordance with Section 703.04B8. <br />C Applicant submittal of an accurately scaled site plan indicating e�sting structures <br />and the proposed attached garage, their exact size, and their distance from <br />property lines (corner pins must be located). Said site plan to be verified by City <br />Staff, based on city records and a site visit (no survey necessary unless corner <br />pins cannot be located). <br />D The review and approval of a building permit be consistent with the approved <br />variance. <br />E The installation of roof gutters to properly direct roof drainage away from the <br />adjacent properties. <br />7.0 PLANNING COMMISSION CONSIDERATION: <br />7.1 On June 5, 2002, the Roseville Planning Commission held the hearing regarding the <br />Wilson variance request. At the hearing no citizens were present to address the <br />Commission; however, the City Planner submitted a letter and an e-mail for two adjacent <br />properiy owners, which indicated opposition to the variance to allow garage/living area. <br />7.2 The Planning Commission did ask Staff a few questions regarding the proposal and the <br />analysis for determining hardship. Specifically, Commissioner Mulder expressed <br />concerns about the living area proposed the garage, which he felt could be constructed <br />somewhere else on the home, reducing the structural impact. <br />7.3 The Commission voted (3 — 1, with Commissioner Duncan abstaining) to recommend <br />approval of a variance to Section 1004.02D5 and Section 602.02 of the Roseville City <br />Code to a11ow construction of an attached garage 13 feet into the required front yard <br />setback and to allow residential vehicle parking in the road right-of-way, for property at <br />3 107 West Owasso Boulevard, based on the findings of Section 5 and conditions of <br />Section 6 of the project report dated June 5, 2002. <br />PF3400 - RCA 061702 - Page 4 of 5 <br />
