EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br />Pursuant to due ca11 and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, NTinnesota, was held on the 17`h day of 7une 2002, at 6:30 p.m. <br />The following members were present: <br />and the following were absent: <br />Council Member introduced the following resolution and moved its adoption: <br />RESOLUTION NO. <br />A RESOLUTION APPROVING A VARIANCE TO SECTION 1004.OZD5 (YARD <br />REQUIREMENTS — FRONT YARD SETSACK) OF THE ROSEVILLE CITY CODE <br />FOR PROPERTY LOCATED AT 3107 WEST OWASSO BOULEVARD (PF 3400). <br />WHEREAS, Robert Wilson has requested a variance to Section 1004.02D5 (Yard <br />Requirements — Front Yard Setback) of the Roseville City Code to allow construction of an <br />attached garage with living space above; and <br />WHEREAS, Mr. Wilson's property is located at 3 107 West Owasso Boulevard and <br />legally described at as: <br />Lot 4, Block 1, Minnesota Realty Co 's Owasso (PID#022923110029) <br />WHEREAS, Section 1004.02D5 requires a minimum principal structure front yard <br />setback of 30 feet in single family residential areas; and <br />WHEREAS, NIr. Wilson desires to replace the existing carport with an attached garage <br />and study room above, 26 feet in depth, that would encroach 13 feet into the required 30 foot <br />setback; and <br />WHEREAS, the Roseville Planning Commission held a public hearing regarding the <br />variance request by Mr. Wilson and recommended (3 — 1, w/one Commissioner abstaining) to <br />approve the request, based on findings outlined in Section 5 and conditions of Section 6 of the <br />proj ect report dated June 5, 2002. <br />NOW TI�REFORE BE TT RESOLVED, by the Roseville City Council, to grant Robert <br />Wilson 13 foot variance to Section 1004.02D5 (yard requirements — Front Yard Setback) of the <br />Roseville City Code based on the findings in Section 5 of the project report dated June 17, 2002, <br />and the following conditions: <br />a The attached garage and living area (above) not encroaching more than 17 feet <br />into the front yard and be a maximum size of 30 feet wide and 26 feet deep. <br />
