The maximum size of a� shelter shall be ten f 10) feet in hei�,ht fourteen <br />(14) feet len�,th. and five (5) feet in width erected upon a concrete pad of maximum <br />size fifteen (151 feet in len�,th and six (61 feet in width. The length of a shelter shall <br />be determined by the Public Works Director and shall be dependent upon the number <br />of buses or vehicles and users that frequent the bus stop. <br />Color: A bench or shelter shall be of a single color except a multicolored advertising <br />sign. Si�i�a�e on benchcs and shelters shall require permits as required Ititi- Chapter <br />1009. <br />G Structure Maintenance: Benches an�} shelters shall be ttl.i i7�:�i �ti ii•.7 an <br />architecturally complimei�t�tiry trash receptacle to be emptied weekly or as fi•equently <br />as necessary by the vendar to comply with the City's health, safety and �vellare <br />cc�ncerns. <br />H. Liability Insurance: A certif'icate of liability insurance shall be filed with the City <br />covering claims for damages which might arise out of the use or placement of a bench <br />or shelter in the public right of way naming the City as an additional insured. The <br />minimum limit of liability shall be six hundred thousand dollars ($600,000.00). <br />L Removal: At the request of the Public Works Director, abench or shelter shallbe <br />removed in order to permit right-of-way improvements or maintenance, If the �*!� ���� ��� �k�•� �� •� ���� <br />location of the bench or shelter is a safety hazard or if it interferes with pedestrian or '"�"'�`' '`` "'` �' "' <br />�.tilk'I.L�{ktiL�J II..� <br />vehicular traffic on the right of way, or �f the bus route changes. the Gti� t�. d�r �hall � <br />incur the cost of removal within 30 days o�l'the route chan�. <br />J. State Or County Permission: If the bench or shelter placement is in a Minnesota <br />Department of Transportation or County right of way, written permission must be <br />secured from the Minnesota Department of Transportarion or the County and filed <br />with the City. (Ord. 921, 2-14-1983; 1995 Code) <br />SECTION 3. Section 10o9.o3is hereby amended as follows: <br />42 F. Public Ways: Signs shall not be permitted within the public right of way or easements <br />43 except on benches and bus shelterswhich have received permits as per Section <br />44 703.05 , and newspaper and cabstands, all of which shall be as governed by Section <br />45 901 and Section 703.05 of this Code; and real estate signs and political signs as <br />46 regulated in this chapter. City, county and state traff'ic directional signs are permitted. <br />
