4.0 VARIANCE REQUEST BACKGROUND: <br />4.1 Section 1004.01 A6 of the Roseville City Code (Nla�mum Total Surface Area) affords <br />each residential property owner up to 30% impervious coverage on a lobparcel, based <br />upon the total lot size. In the case of the Bemtsen properiy this allowance cannot exceed <br />3790 square feet without an approved variance. <br />4.2 The Bemtsen home was constructed in 1994 and is situated on a 12,632 square foot lot. <br />The home/garage has a footprint estimated at 2,556 square feet and driveway area of <br />1,440 square feet. Given these current site conditions the Bemtsen lot has a pre-e�sting <br />non-conforming impervious coverage of 3,996 square feet or 32%. <br />4.3 The proposed master suite addition would create a total impervious coverage of 4,361 <br />square feet or 35%. <br />4.4 The proposed addition, should the Planning Commission recommend and City Council <br />approve the variance request, would require NIr. Bemtsen to apply for and receive a <br />setback permit to encroach into the required side yard setback. <br />4.5 The need for a Setback Permit is premised on the pie shaped lot design, which is 130 feet <br />along Heinel Drive and 45 feet at the lots rear property line. Given the angles of the lot <br />lines and the placement of the principal structure, it is impossible to construct an addition <br />that would not encroach into a portion of the required setback. <br />4.6 The lot adjacent (south) to the Bemtsens proposed addition is vacant; however, the <br />vacant lot is owned by George Reiling and he has indicated that he is not opposed to the <br />vanance request. <br />5.0 STAFF COMMENTS/FINDINGS: <br />5.1 The Bemtsen home was constructed (1994) prior to the te�t amendment to Section 1004 <br />that established the 30% impervious coverage requirement. The Bemtsens are now <br />faced with needing a variance in order to expand their home to meet their needs/desires <br />(see attached narrative). <br />5.2 Section 1013.02 states: Where there are practical difficulties or unusual hardships in the <br />way of carrying out the strict letter of the provisions of this code, the city council sha11 <br />have the power, in a specific case and after notice and public hearings, to vary any such <br />provision in harmony with the general purpose and intent thereof and may impose such <br />additional conditions as it considers necessary so that the public health, safety, and <br />general welfare may be secured and substantial justice done. <br />PF3413 - RCA 081902 - Page 2 of 4 <br />
