Section 2.03. Council composition and election. The council sha11 be composed of a mayor and four or siY councilmembers, as determined by the council who sha11 be qualified electors. Each councilmember sha11 serve for a term of four years and until his or her successor is elected and qualifies. The mayor sha11 serve for a t erm of four years and until llis or her successor is elected and qualifies. The Council may provide by ordinance for the election of city council members by wards. The ordinance may also provide for staggering of terms. Minnesota election law, including Minnesota statutes 204B.135 and 205.84,as they may be amended from time to time, relating to wards, appliesto any wards established by the council Section 2.04. Incompatible offices. N o member of the council shall be appointed city manager, nor shall any member hold any paid municipal office or employment under the city; and until two years after the expiration of his or her term as mayor or councilmember no former member sha11 be appointed to any paid appointive office or employmentunder the city which was created or the compensation for which was increased during his or her tcrm as councilmcmber. Section 2.05. Vacancies. An elective ot�ice becomes vacant when the person elected or appointedthereto dies before taking offi ce or fails to qualify, or the incumbent dies, resigns in writing filed with the city manager, is convicted of a felony, ceases to reside in the city, or is adjudged incompetent by a court of competent jurisdiction. If the unexpired term of the council vacancy is less than one year fro m the date ofthe Occurrence of the vacancy, the council by a majority vote of a11 its remaining members sha11 appoint a qualified person to fill the vacancy. If the council fails to make the appointment within sixty (60) days of the occurrence of the vacancy, the mayor sha11 fill the vacancy fz�om the list of qualified applicants. lf the unexpired term ofthe council vacancy is one year or longer from the date of the occurrence of the vacancy, a special election sha11 be called by the city manager to fill the vacancy. Subdivision 1. Procedures to Fill Council Vacancies by Special Election. If the unexpired term of the council vacancy is one year or longer, a special election shall be called by the city manager. The election will be held not sooner than ninety (90) days and not later than one hundred twenty (120) days following the occurrence of the vacancy and wit] otherwise be govemed by the provisions of Section4_02, Special Elections.
