The City simply does not spend so much <br />money each year on a Development Attorney as to justify designating one firm to provide that <br />service. Last year the city spent less than $10,000 on Development Attorney services. This <br />contrasts with the $106,000 spent last year on Prosecuting Attorney services and the $96,000 <br />spent on City Attorney services. With those kinds of expenditures for Prosecuting Attorney and <br />City Attorney it makes sense to negotiate with and work with one law firm for each type of <br />service on an on-going basis. <br />However, we have a much smaller need for Development Attorney services. Occasionally, we <br />need sophisticated legal and financial assistance on some particular aspect of a development <br />proj ect. Rather than designate one law firm to handle a sma11 assortment of such development <br />attorney services, we recommend that staff use a specialist who handles the type of specific legal <br />or financial problem that arises. Such an approach would provide the occasional specialized <br />service we need without ha�ing to maintain an on-going relationship with one designated <br />Development Attorney law firm. <br />Hence, staff recommends that no one firm be designated as the city's Development Attorney, but <br />instead staff be authorized to use specific professional services to help solve specific <br />development problems on an issue-by-issue basis. Of course, bills for such specialized services <br />would be submitted for Council approval along with other city bills. <br />4.0 FISCAL IMPACT: <br />Sufficient funds are budgeted in the 2002 and in the preliminary Council-approved 2003 budget to <br />pay for these specialized development services. <br />Development Attorney Review Page 2 of 2 <br />
