AN ORDINANCE AMENDING TITLE 10, SECTION 1016, SHORELAND DISTRICT, BY ADDING LANGUAGE �VHICH DEFINES FENCES AS STRUCTURES �VHEN PLACED IN THE SHORELAND DISTRICT AND PROHIBITS PLACEI��NT OF FENCES SHORE�VARD OF THE PRINCIPAL STRUCTURE OR ANY PERI�IITTED DECK. THE CITY OF ROSEVILLE ORDAINS: SECTION 1. Purpose. The Roseville City Code, Title 10, Section 1016, is hereby amended by adding or revising language necessary to define fences as structures within the Shoreland District and to provide additional regulation regarding their placement on property with water frontage. The purpose of this ordinance is to provide visual access, private open space, and reduced impacts of man-made structures within the non-buildable portion of the Shoreland District, between the principal structure and the shore line. SECTION 2. Section 1016.05 (Definitions) is hereby amended as follows: STRUCTURE: Any building or appurtenance, including attached or detached decks and fences. "Structure" does not include aerial or underground utility lines, such as sewer, electric, telephone, telegraph, gas lines, towers, poles, seasonal docks, and other supporting facilities such as at-grade driveways and patios. SECTION 3. Section 1016.16 B. (Additional Structure Standards For All Districts) is hereby amended by adding the following subsection 3 as follows: Section 1016.16 B 3. In bluff im�act. shoreland. and wetland zones. fences shall be setback the same distance from the shore line as required for the principal structure or attached deck on the lot_ exce�t that a fence on a lot with a�re- existin�4brincipal structure and attached deck mav e�tend to the same setback as the deck or the structure. Fences shall be of similar design, te�ture, and color as the principal structure or shall be of an earth tone or color and material. Fences used for safety or containment may he set within 25 feet of the OHWL. Such fences shall be a maximum of 25% opaque. and nor more than 42 inches in hei�ht. Such fences sha11 be clad in earth tone coatin�s . With the exception of re�ulations in this subsection, fences in bluff impact, shoreland. and wetland zones shall meet all hei�ht and setback re�uirements of the Citv Code_ Section 1012.02. Fences �laced on the road side of a lot with water or wetland fronta�e shall comblv with front vard fence re�uirements of Citv Code� Section 1012.02. SECTION 4. Effective Date. This ordinance shall take effect following its passage and publication.
