REQUESTFORCOUNCILACTION <br />DATE: 10/ 14/02 <br />ITEM NO: VIII B <br />D artment Approval: Mana er proved: Agenda Section: <br />�1�"" �/1pB� �.� �poxTs <br />Description: Administrative review of Kathleen Agness (Schorn Realty) <br />Interim Use Permit on properiy located at 2256 Lexington <br />Avenue (PF33291 <br />1.0 REQUESTED ACTION <br />1.1 When Kathleen Agness requested an Interim Use Permit (City Code <br />Section1012.09) on the property located at 2256 Le�ngton Ave to establish a <br />realty and mortgage office, the Council adopted Resolution 9941 (September 24, <br />2001) which states that an annual administrative review be done and reported to <br />the Planning Commission and City Council. <br />2.0 BACKGROUND <br />2.1 Kathleen Agness is legally operating an interim use office which includes Schorn <br />Realty and River Valley Mortgage, at 2256 Le�ngton Avenue in a residential <br />building formerly known as the Rymer Music Academy and formerly a single <br />family home within an "R-1" Single Family zoning district. (To this date the <br />zoning remains "R- 1"; the Comprehensive Plan remains "LDR" Low Density <br />Residential.) <br />2.2 One of the purposes of the Interim Use Permit is preserve the character of the <br />original residential architecture and site improvements and the compatibility with <br />the e�sting neighborhood. No e�terior remodeling has been necessary. <br />2.3 The Council determined that the proposed office within a residential structure was <br />an interim use. The conditions under which it would be operated would not be <br />detrimental to the public health, safety or welfare, or injurious to properties or <br />improvements in the vicinity. <br />2.4 Section 1012.09B states: The City Council may attach conditions to interim use <br />permits. In reviewing interim use permit applications, the City will establish a <br />specific date or event that will terminate the use on the property. The Council <br />will also determine that the approval of the interim use would not result in adverse <br />effects on the public health, safety and general welfare, and that it will not impose <br />additional costs on the public if it is necessary for the public to take the property <br />in the future. <br />Agness/Schorn ITJP Review, PF 3329 RCA (101402) Page 1 <br />
