While the fence is not on your <br />property, the owner, Sally Goodroad, is concerned that the snowplow operators on March 15, <br />2002, (7:30 am) actually pushed snow into the fence and damaged a panel on the south end of the <br />fence and pushed out slats along the north end of the fence. By noon the same day, the plow <br />operators shoveled snow from around the fence and pushed the slats into place. They explained <br />that they would be back later in the spring to fix it better. <br />In a chronology of pictures and notes from March through May, 2002, the fence slats began to <br />pop loose again due in part to the snow and wind loading as well the poor ancharage after the <br />March 15 snow. By May 8 Mrs. Goodroad had called you to determine next steps. Eventually a <br />panel fell. <br />In mid May you and I talked about the 90 day fix up period the Council gave you as part of the <br />Interim Use Permit beginning in September, 200L I agree that your or�repair of the fence <br />was completed during that 90 day period. The March 1$�' occurrence appears to be a second snow <br />episode, wherein the snowplowers pushed the hea�y snow into the Goodroad fence. Repair of this <br />damage should ha�e been the responsibility of the snowplowers and/or their insurance company. <br />The liability and responsibility for the second event -the March 2002 snow plowing damage and <br />repair - is a private matter much as an auto accident. The City's interest is in seeing that a <br />screening fence between the business and residential uses remains in place along your east <br />border. Please make your best effort to resolve this damage in a neighborly manner. <br />Thank you for your cooperation. <br />ennis P.
