REQUEST FOR PLANNING COMIVIISSION ACTION <br />DATE: 10/21/02 <br />ITEM NO: X. B. <br />Department Approval: Agenda Section: <br />DPW/TP 01�1N.A1�T��, <br />Item Description: Second reading of Twin Lakes rezoning to B-6, 1�Tixed Use Business <br />Park; and, a request by property owners for clarification of pre- <br />existing, nonconforming uses and text within the Roseville City Code <br />Section 1005.07 (B-6, Mixed Use Business Park Districts) prior to any <br />rezoning (PF3359). <br />1.0 SUMMARY: <br />In June, 2002, the City Council held a first reading for a Twin Lakes area map change from an <br />assortment of uses and zones to a B-6, mixed use business park At that time interested proper-t' s� <br />owners requested the Council to protect their interests in the e�sting buildings and uses within Twm <br />Lakes. A portion of the B-6 te�t language stated that the pre-existing non-conforming uses would not <br />be allowed to expand, intensify or be replaced in kind. From 7uly though September properiy owners, <br />staff, and the Planning Commission met to consider methods of approving the rezoning while <br />protecting the pre-e�sting and non-conforming uses and buildings now on the site should the zoning <br />change to B-6. Some progress was made, wording was clarified, the te�t of the B-6 zoning ordinance <br />is now being reviewed for clarity and inclusiveness consistent with the Master Plan. <br />2.0 RECOI�TI�TENDATIONS: <br />On October 2, 2002, the Planning Commission (and staf� recommended to the City Council that <br />the Twin Lakes area B-6 rezoning request be denied. Instead, the Commission and staff <br />recommended that, to remain consistent with the Council concept of market based <br />redevelopment, the individual properiy owner should come forth with their B-6 rezoning requests <br />at the time that their properiy is ready for redevelopment. This allows the pre-e�sting and/or <br />non-conforming uses to remain "as-is" within the e�sting I-2, I- 1, B- 1, and B-4 zones. <br />The Commission stated: <br />Motion: Member Pepper moved seconded by Member Bakeman, to recommend <br />Any Planning Commission recommendation on language changes to the B-6 zoning <br />district be tabled until November 4, 2002, and that the City Attorney and staff are to <br />retain the existingpre-existing, nonconformity language, andfurther that the City <br />Attorney and staff are to prepare specific clarification language for Section 1005. 07A <br />and B regarding "`permitted uses and ancillary uses ". <br />Member Traynor stated he will support the motion, change has been planned for 1 S <br />years, but the City must get moving on the site.
