City of Roseville
PRE-EXISTING NONCONFORIIING USES DEFINITIONS AND PROCEDURE
Draft: August 7, 2002
Definitions: Pre-existinE Nonconformin Lots, Uses and Structures
Within the Roseville Zoning Code and Districts, lots, uses of land, and structures exist which
were permitted before the ordinances were passed or amended. These may be prohibited,
regulated, or restricted under the terms of the current City Code or future amendments. It is the
intent of the Roseville Zoning Code to permit these per-esting nonconforming lots, uses and
structures to continue so long as they remain otherwise consistent with the City Codes.
1. The following provisions apply in determining the nonconforming status and whether the
lot, use or structure may be altered or further developed.
Within a multi-tenant building or single use building a business that includes a
pre-esting nonconforming use cannot intensi that pre-esting nonconforming
use portion of the business. "Intensified use" is defined as a use that would create
a substantially more detrimental impact to the building or adjacent area. (See the
attached definition of "detrimental impact").
b. A nonconforming lot, use or structure may not be enlarged, moved, changed or
eended beyond the scope and area of its operation or the eerior building
dimensions at the time when it became a legal nonconforming use, without a
variance. Any structure or portion thereof may be altered to decrease its non-
conformity.
c. Uses or structures, which are prohibited elsewhere in the same zoning district, are
not permitted to move to lots with other nonconforming uses or structures
(thereby expanded an esting non-conformity).
d. Should a structure be moved for any reason for any distance, it will thereafter
conform to the regulations for the district in which it is located after it is moved.
e. If any legal, pre-esting nonconforming use of land, structure, or combination, is
changed to a permitted use, then the legal nonconforming use status is removed
and cannot be resumed. (An exception would be within the building shell where
a mix of permitted and non-conforming uses reside and expand or contract based
on need or vacancy.)
f. When a legal, pre-esting nonconforming use of land, structure, or combination
is discontinued or abandoned for twelve (12) consecutive months, the
nonconforming use status is removed and cannot be resumed. (An exception
would be within the building shell where a mix of permitted and non-
conforming uses reside and expand or contract based on need or vacancy.)
PF3359-RCA(102102) Page 11 of 13
