That pursuant to M.S.A. 161.24 and M.S.A. 161.38 the work on the frontage road and entrances will be done in conjunction with the reconstruction oz Victoria Street within the Village substantially as shown on the plans for S.P. 6212-97 (T.H. 36=118) on ~ile in the office of the Commissioner of Highways, St. Paul, ~~nnesotaJ and which plans are made a part hereof by reference. II. The Village agrees to maintain the ~rontage road and entrances at its sole cost and expense from the time the travel.ed portions of said road and entrances are completed and opened to traf~ic until the conveyance of Victoria Street, inCluding said frontage road and entrances, is accomplished. III. The Village indemnifies, saves and holds harmles$ the State and all of its agents and employees from any and all claims, actions or causes of action of any kind or nature whatsoever ariSing out of or by reason or the maintenance work pro- vided for herein to be performed by the Village and further agrees to defend at its sole cost and expense any action or proceeding commenced for the purpose of asserting any claim of any nature or kind ariSing out of said maintenance work. IV. All employees of the Village and all other employees while engaged in said maintenance shall not be considered employees of the state and all claims that may arise under the Workmen'S Compensation Act of the State of Minnesota on behalf of said employees while so engaged and any claims made by any third parties as a consequence of any act or omission on the part of said employees while so engaged on said maintenance shall in no way be the obligation or responsibility of the State and the Village holds the State harmless from any and all such Claims. ..2-
