<br />EXTRACT OF MINUTES OF MEETING OF THE VILLAGE COUNCIL <br />OF ROSEVILLE, MINNESOTA, HELD DECEMBER 27, 1971 <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />Pursuant to due call and notice thereof, a regular meeting of <br />the Village Council of the Village of Roseville, Minnesota, was duly called <br />and held at the Village Hall in said Village on December 27, 1971. <br /> <br />The following members were present: Mayor Moll, Comcilmen Anderson, <br />Curley, Grauel and Linebarger <br />and the following members were absent: None <br /> <br />Member Grauel <br />moved its adoption: <br /> <br />introduced the following Resolution and <br /> <br />RESOLUTION NO. 5781 <br /> <br />WHEREAS, a lawsuit has been commenced in United States <br />District Court for the Northern District of Alabama on behalf of all <br />municipalities and public agencies who own and operate water distribution <br />systems against certain manufacturers of cast iron pipe and fittings; and <br /> <br />WHEREAS, said lawsuit alleges that those manufacturers violated <br />the Federal Antitrust Laws by conspiring and acting in concert to fix prices <br />and allocate markets in the sale of cast iron pipe during the period of 1945 <br />to 1970; and <br /> <br />WHEREAS, said lawsuit seeks treble damages because as a result <br />of such action public agency purchasers of cast iron pipe and fittings have <br />paid higher prices than they otherwise would have paid; and, <br /> <br />WHEREAS, the Village of Roseville does operate a water distri- <br />bution system and has been notified by the Clerk of District Court in Alabama <br />that it may participate in said lawsuit as a party plaintiff upon the filing <br />of proper notice prior to January 3, 1972; and <br /> <br />WHEREAS, the Public Works Department for the Village of Roseville <br />has determined that the Village has spent apprOximately $180,000.00 since <br />1966 for the installation of cast iron pipe in its water distribution system; and <br /> <br />WHEREAS, it appears likely that the Village of Roseville would <br />benefit financially in the event of a favorable verdict on behalf of all munici- <br />palities participating either through present counsel employed on behalf of <br />
