WHEREAS, the Village has been unable to negotiate for the purpose of purchasing said land; and WHEREAS, under the statutes of the State of Minnesota the Village has the power to take and acquire such property by power of eminent domain; NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL FOR THE VILLAGE OF ROSEVILLE, MINNESOTA, AS FOLLOWS: The Village Council hereby deems it necessary and convenient that the property described below be acquired by the Village of Roseville for the Roseville Park, all of said property being situated in the Village of Roseville, County of Ramsey and State of Minnesota, to-wit: Except the East Three Hundred Thirty Feet (E.330') and except the West Three Hundred Fifty Feet (W. 350'), the North Quarter of the South One- Half (N.l/4 of S. 1/2) of the Southwest Quarter of the Northeast Quarter (SW.l/4 of NE.l/4) of Section Ten (10), Township Twenty-Nine (29), Range Twenty-Three (23), according to the plat thereof on file and of record in the office of the Register of Deeds in and for Ramsey County, Minnesota. BE IT FURTHER RESOLVED that the estate to be acquired lS fee simple absolute. That the Village Attorney be and he hereby is instructed to institute the necessary proceedings in condemnation under the power of eminent domain in the name and in behalf of the Village of Roseville, Minnesota, to acquire the property hereinabove described under the statutes of the State of Minnesota, and the said Village Attorney is further instructed and directed to take such steps as may be necessary to carry said proceedings to a conclusion. The motion for the adoption of the foregoing resolution was duly seconded by l1ember Kustermann , and upon a vote being taken thereon, the following voted in favor of the resolution: Mayor ~1cGee, Trustees Reinecke, Flanagan, Goodrich and Kustermann and the following voted against the same: None WHEREUPON said resolution was declared duly passed and adopted.
