<br />WHEREAS, the Village has been unable to negotiate for <br />the purpose of purchasing said land; and <br /> <br />WHEREAS, under the statutes of the State of Minnesota <br />the Village has the power to take and acquire such property <br />by power of eminent domain; <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL <br />FOR THE VILLAGE OF ROSEVILLE, MINNESOTA, AS FOLLOWS: <br /> <br />The Village Council hereby deems it necessary and <br />convenient that the property described below be acquired by <br />the Village of Roseville for the Roseville Park, all of said <br />property being situated in the Village of Roseville, County <br />of Ramsey and State of Minnesota, to-wit: <br /> <br />Lots Thirty-Six (36) and Thirty-Seven (37), <br />Block One (1), Minnesota Realty Co's Owasso, <br />according to the plat thereof on file and <br />of record in the office of the Register of <br />Deeds in and for Ramsey County, Minnesota. <br /> <br />BE IT FURTHER RESOLVED that the estate to be acquired <br />is fee simple absolute. <br /> <br />That the Village Attorney be and he hereby is instructed <br />to institute the necessary proceedings in condemnation under <br />the power of eminent domain in the name and in behalf of the <br />Village of Roseville, Minnesota, to acquire the property <br />hereinabove described under the statutes of the State of <br />Minnesota, and the said Village Attorney is further instructed <br />and directed to take such steps as may be necessary to carry <br />said proceedings to a conclusion. <br /> <br />The motion for the adoption of the foregoing resolution <br />was duly seconded by Member Kustermann , and upon <br />a vote being taken thereon, the following voted in favor of the <br />resolution: <br /> <br />Mayor McGee, Trustees Reinecke, Flanagan, Kustermann <br />and Goodrich <br /> <br />and the fOllowing voted against the same: <br /> <br />None <br /> <br />WHEREUPON, said resolution was declared duly passed and <br />adopted. <br /> <br />Page Two <br />
