<br />EXTRACT OF MINUTES OF MEETING OF THE VILLAGE <br />CaJNCIL OF ROSEVILLE, MINNESOTA - HELD <br />October 16, 1972 <br /> <br />* * * * * * * * * * * * * * * * * * * * * * * * * * * * * <br /> <br />Pursuant to due call and notice thereof, a regular meeting <br />of the Village COlIDCil of the Village of Roseville, Minnesota, was <br />duly called and held at the Village Hall in said Village on Monday, <br />October 16, 1972, at 7:30 P.M. <br /> <br />The following members were present: Mayor Linebarger, <br />Councilmen Brennan, ilirley, Grauel and Anderson <br /> <br />and the following were absent: None <br /> <br />Member Curley introduced the following resolution and moved <br />its adoption: <br /> <br />RESOllITION NO. 5889 <br /> <br />WHEREAS, the City of Brooklyn Center and other rmmicipalities <br />have or will connnence legal proceedings to test the validity of the <br />action of the Metropolitan Council in its detennination to adopt a <br />new fonnula for the allocation and collection of certain "current <br />costs" to be borne by nnmicipal governments pursuant to Chapter 473C <br />of Minnesota Statutes; <br /> <br />NOW, THEREFORE, the lIDdersigned nnmicipalities express their <br />agreement with the obj ective of the aforementioned lawsuit and auth- <br />orize the attorneys engaged by the City of Brooklyn Center to act as <br />its attorney for the purpose of joining or intervening as a party <br />litigant to said legal action. The right of any nnmicipality to employ <br />counsel of its own choice is in no way enfringed. <br /> <br />NOW, THEREFORE, the undersigned nnmicipality agrees to share <br />equally with all other participating municipalities in the costs and <br />expenses of said legal action, including attorneys fees, except that <br />no party other than the City of Brooklyn Center shall be obligated to <br />the extent of more than $500.00 by this agreement. The pro rata share <br />of the expenses and fees attributable to each rmmicipality shall be <br />calculated at 60 day intelVals beginning January 2, 1973, and shall <br />be payable on 30 days notice. <br /> <br />TEIMINATION OF AGREEMENf <br /> <br />This Agreement may be tenninated as to any party by 15 days <br />written notice to each of the other participating municipalities, <br />provided, however, that the pro rata share of legal fees and expenses <br />
