WHEREAS, the Village has been unable to negotiate for the purpose of purchasing said land; and WHEREAS, under the statutes of the State of IvIinnesota the Village has the power to take and acquire such property by power of eminent domain; NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL FOR THE VILLAGE OF ROSEVILLE, MINNESOTA, AS FOLLOWS: The Village Council hereby deems it necessary and convenient that the property described below be acquired by the Village of Roseville for the Roseville Park, all of said property being situated in the Village of Roseville, County of Ramsey and State of Minnesota, to-wit: Subject to Hamline Avenue, that part of the North Half of the Northwest Quarter (N.l/2 of NW.l/4) lying South (S) of a line Thirty feet South (30'S.) and parallel with the North line of Roseville Terrace Plat Six (6), extended Eastward and East (E) of East line of Roseville Terrace, Plat Six (6); and subject to Hamline Avenue, that part of the South Half of the Northwest Quarter (S.1/2 of NW.l/4) East (E) of Roseville Terrace, Plat Six (6) and North (N) of Roseville Terrace Plat Four (4), all in Section Three (3), Township Twenty-nine (29), Range Twenty-three (23), according to the plat thereof on file and of record in the office of the Register of Deeds in and for Ramsey County, Minnesota. BE IT FURTHER RESOLVED that the estate to be acquired is fee simple absolute. That the Village Attorney be and he hereby is instructed to institute the necessary proceedings in condemnation under the power of eminent domain in the name and in behalf of the Village of Roseville, Minnesota, to acquire the property hereinabove described under the statutes of the State of Minnesota, and the said Village Attorney is further instructed and directed to take such steps as may be necessary to carry said proceedings to a conclusion.
