<br />WHEREAS, the Village has been unable to negotiate for <br />the purpose of purchasing said land; and <br /> <br />WHEREAS, under the statutes of the State of Minnesota <br />the Village has the power to take and acquire such property <br />by power of eminent domain; <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL <br />OF THE VILLAGE OF ROSEVILLE, MINNESOTA, AS FOLLOWS: <br /> <br />The Village Council hereby deems it necessary and <br />convenient that the property described below be acquired by <br />the Village of Roseville for the Roseville Park, all of said <br />property being situated in the Village of Roseville, County <br />of Ramsey and State of Hinnesota, to-wit: <br /> <br />The South Five Hundred Feet (S.500') of the <br />East Four Hundred Eight and nine-tenths Feet <br />(E.408.9') of the West Eight Hundred Seventeen <br />and eight-tenths Feet (W.817.8') of the North <br />One-half of the Northeast Quarter (N.l/2 of <br />NE.l/4) of Section Twelve (12), Township <br />Twenty-Nine, Range Twenty-three (23), according <br />to the plat thereof on file and of record in <br />the office of the Register of Deeds in and for <br />Ramsey County, Minnesota. <br /> <br />BE IT FURTHER RESOLVED that the estate to be acquired <br />lS fee simple absolute. <br /> <br />That the Village Attorney be and he hereby is instructed <br />to institute the necessary proceedings in condemnation under <br />the power of eminent domain in the name and in behalf of the <br />Village of Roseville, Minnesota, to acquire the property <br />hereinabove described under the statutes of the State of <br />Minnesota, and the said Village Attorney is further instructed <br />and directed to take such steps as may be necessary to carry <br />said proceedings to a conclusio~. <br /> <br />The motion for the adoption of the foregoing resolution <br />was duly seconded by Hember ~~~ ' and upon <br />a vote being taken thereon, the -ollowlng voted in favor of the <br />resolution: 777 /77'-~ t?~ 1~-uJ ~ . <br />r~ j -;1 / ~ <br />/,~ ""- r/L~ <br /> <br />and the following voted against the same: ~ <br /> <br />WHEREUPON, said resolution was declared duly passed <br />and adopted. <br /> <br />Page Two <br />
