<br />EXTRACT OF MINUTES OF MEETING <br />OF CITY COUNCIL <br />CITY OF ROSEVILLE <br />RAMSEY COUNTY, MINNESOTA <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, Minnesota was duly held at the City Hall in said City on Monday, the thirteenth day of <br />February, 1995, at 5:00 p.m. <br /> <br />The following members were present: Wiski, P. Johnson, Mastel, and Goedeke and the following <br />were absent: V. Johnson. <br /> <br />Councilperson P. Johnson introduced and moved the adoption of the following resolution: <br /> <br />RESOLUTION NO. 9153 <br /> <br />RESOLUTION DETERMINING TO ACQUIRE BY CONDEMNATION UNDER THE <br />POWERS OF EMINENT DOMAIN CERTAIN EASEMENTS FOR PERMANENT <br />ROADWAY AND UTILITY PURPOSES, AND TEMPORARY CONSTRUCTION, AND <br />DIRECTING THE NECESSARY PROCEEDINGS BE INSTITUTED BY THE CITY <br />ATTORNEY FOR SUCH PURPOSE. <br /> <br />WHEREAS, the City Council for the City ofRoseville has approved a project to acquire certain <br />property by reason of construction of a roadway and utilities, said improvement identified by City <br />records as Improvement No. 93-lOa; and <br /> <br />WHEREAS, the City Council has been advised by competent advisers that the following <br />described real property is necessary for the construction of the roadway; and <br /> <br />WHEREAS, the City has been unable to agree on a negotiated amount for some of the easements <br />to be acquired; and <br /> <br />WHEREAS, under Minnesota Statute 412.211 and Minnesota Statute Chapter 117, the City has <br />the power to take and acquire easements by way of eminent domain; <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />ROSEVILLE, MINNESOTA, AS FOLLOWS: <br /> <br />The City Council of the City ofRoseville hereby deems it necessary and convenient that perpetual <br />and temporary construction easements on the properties described in Exhibit A and Exhibit B <br />attached as part of this resolution be acquired by the City ofRoseville for the purposes above <br />described. <br /> <br />Further, that the City Attorney be and hereby is instructed to commence the necessary <br />proceedings in condemnation under the power of eminent domain in the name and in behalf of the <br />
